Terms and Conditions for Tractor and Implement Purchases
1. General Overview
By purchasing a tractor or implement from Nicola's Machinery Pty Ltd (the "Company"), you agree to these Terms and Conditions. These terms outline the delivery and shipping policies, as well as the conditions under which free or capped delivery costs may apply. Please read the terms carefully to ensure you understand and agree with them before proceeding with your purchase.
Note:For the purposes of these Terms and Conditions, an "implement" refers to any product listed on our website other than a tractor, including but not limited to tractor implements, zero turn mowers, excavators, UTVs, engine powered wood chippers, generators and fuel tanks, parts, and filters.
2. Eligibility for Free Tractor Delivery
(a) Free Delivery Areas
Free delivery is available for customers purchasing a tractor from the Company in most areas of Queensland (QLD), New South Wales (NSW), Victoria (VIC), and South Australia (SA).
To check if your location qualifies for free delivery, please contact our sales team for confirmation.
(b) Tractor Purchases
If you purchase a tractor from the Company and are located within the eligible free delivery areas, you will receive free delivery of the tractor to your location.
3. Implements Delivery Policy
(a) Implements Purchased with a Tractor
If you purchase a tractor along with implements, and the tractor qualifies for free delivery, the implements will be delivered together with the tractor at no additional shipping cost. This combined delivery will occur at one time and to one location.
(b) Implements Purchased Independently
If you purchase implements separately (without a tractor), a shipping cost will apply. Please contact the Company directly for a shipping quote.
4. Delivery Times and Process
(a) Delivery Timeframes
Delivery times may vary depending on your location and the availability of products. Typically, delivery will be arranged within 3-10 business days after the order has been processed, but specific timelines will be confirmed at the time of order.
(b) Delivery Tracking
Once your order is dispatched, you will receive tracking information to monitor the progress of your delivery.
5. Changes and Cancellations
(a) Delivery Changes
If you need to make changes to your delivery address or schedule, please notify the Company as soon as possible. We will do our best to accommodate changes, but once the delivery is in progress, changes may not be possible.
(b) Order Cancellations
If you wish to cancel your order before dispatch, please contact the Company immediately. Cancellations may be subject to applicable charges depending on the stage of processing.
If the payment was made online, please be aware that service fees applied by third-party payment processors (such as credit card transaction fees) will not be refunded. The Company reserves the right to charge a service fee for cancellations, which will be deducted from the refund amount.
(c) Refunds for Cancellations
If your order is canceled and a refund is issued, the amount refunded will be minus any applicable service fees. These service fees may include, but are not limited to, online transaction fees or third-party processing fees. The service fee charged by the third-party payment provider will not be refunded to the customer under any circumstances.
6. Refund Policy
An unconditional refund can be made within 48 hours after the Company’s bank receives the full payment, provided that the products have not yet begun shipping (i.e., the products have not been collected by the freight company from our local stores).
Please note that any service fees charged by third parties, such as card transaction fees or payment processing fees, will be subtracted from the refund amount. These fees are non-refundable and will be deducted from the total refund.

7. Damages and Issues
Please inspect your order upon reception and contact us immediately if the item is defective, damaged, or if you receive the wrong item, so that we can evaluate the issue and make it right.
8. Exchanges and Returns
The fastest way to ensure you get what you want is to return the item you have, and once the return is accepted, make a separate purchase for the new item. The cost of returning the products (e.g., shipping cost) will be borne by the purchaser.
To be eligible for an exchange or return, your item must meet the following conditions:
- Condition: The item must be in the same condition that you received it, unworn or unused, and free from any damage.
- Packaging: The item must be returned in its original packaging, including any tags, manuals, or accessories that came with the product.
- Proof of Purchase: You will need to provide the invoice or proof of purchase when requesting an exchange or return.
- Return Timeframe: Returns must be made within 15 business days of receiving your order.
Note: The customer will be responsible for returning any item to the closest warehouse at their own cost. Return shipping charges are the responsibility of the customer. Please contact the Company for the nearest return address.
9. Damaged Goods
(a) Reporting Damaged Goods
If your order arrives damaged or incomplete, please notify the Company within 1 business day to arrange for a resolution.
(b) Resolution of Damaged Goods
The Company will review the claim and may offer a replacement, repair, or other appropriate solutions based on the condition of the items.
10. Additional Charges
(a) Shipping for Non-Eligible Areas
If your location is outside of the eligible free delivery zones, additional shipping charges will apply. You will be informed of these charges prior to order completion.
(b) Storage Fees
In the event that delivery cannot be completed due to no one being present to receive the goods, additional storage and re-delivery fees may apply.
11. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the State of South Australia (SA), Australia. Any disputes related to these Terms and Conditions will be resolved under the jurisdiction of the courts located in South Australia, or the relevant courts in the States where our branches are located, including Queensland (QLD), New South Wales (NSW), and Tasmania (TAS).

13. Changes to Terms and Conditions
The Company reserves the right to amend these Terms and Conditions at any time without prior notice. Any changes will be posted on our website, and by continuing to make a purchase, you agree to the updated terms.
14. Use of Tractor or Implements
If a customer has used the tractor or implements, the exchange or return policy does not apply. Any issues or defects that arise after the goods have been used will be considered a warranty claim and will be subject to the Company's warranty policy. Warranty claims will be handled in accordance with the terms and conditions of the manufacturer’s warranty and may require assessment by an authorized service provider.
